Motiv Client Agreement

Thank you for joining Motiv Personal Training. We know that you will enjoy working out with us.

This is a contract. In this agreement, “us” and “we” refers to Motiv Personal Training LLC and “you” refers to you, our client. We like to keep things simple, so here are all the key terms, in one neat place:

Appointments

All of your training sessions are by appointment. You can set, modify and cancel all your appointments by either: a) our online scheduling system at our website (or via the shortcut: www.motivlogin.com), b) sending an email to schedule@motivpersonaltraining.com or by calling us at 773.675.1420. The fastest and best way to schedule is via our online scheduling system. If you schedule your appointments online, you are solely responsible for the accuracy of those appointments, just like if you were booking a flight online

Cancelling Appointments

If you need to cancel an appointment, we ask that you do so at least 12 hours in advance of the start time so that someone else may take your space. The best way to cancel your appointments is online using the online scheduling system. If you do not cancel an appointment 12 hours in advance or do not show up for an appointment for any reason—including illness – that session will be treated as a “late cancel.”

If you late cancel an appointment and another client takes your place, for example, off of a waitlist, you will not be charged with a late cancel.

We urge you not to late cancel your sessions. If you have frequent late cancellations, defined as more than 2 per calendar month, we reserve the right to suspend your online and/or advanced booking privileges or even terminate this agreement.

Maximum Coaching Sessions per Week Scheduled Online

You may schedule a maximum of 3 sessions per week online. In our professional judgment, we believe that you should only complete a maximum of 3 resistance training workouts per week. We believe that a 4th training session per week will lead to diminishing returns and an increased risk of injury. Rather than attend a 4th training sessions per week, we would recommend you attend a MotivGroup training session instead. If you wish to complete a 4th personal training session in a week please call the studio and we will schedule it for you.

Medical Account Suspensions

If you develop a medical condition or injury that makes you unable to workout, you may suspend your account for minimum of 30 days up to a maximum of 120 days. To suspend your account on a “medical hold,” you must provide a written note from your physician; your suspension will begin on the date we receive the written notice from your physician.

Scheduling Restrictions – Non-Peak Agreements Only

If you package has the words “Non-Peak” in its title, you are restricted to scheduling sessions that begin at 8:15am, 9:00am and 9:45am on Weekdays. You may not schedule at any other time, including Saturdays. You are welcome to attend any MotivGroup session at any time of day.

Contract Early Termination Penalty

If you choose to cancel your contract before the expiration of your contract term, you will be charged for the current month PLUS a cancellation penalty of $125 per unbilled month of your contact. For example, if you choose to terminate your membership and have 3 unbilled months remaining after the current month, you would be charged a $375 penalty plus your current months billing. You must give notice of you your intent to terminate early in writing (email is fine). This penalty will serve as liquidated damages.

Billing & Declined Payment Charges

Your monthly payment is due on the monthly anniversary of this agreement. All monthly invoice payments must be made by automatic Bank Debit (ACH) or Credit/Debit Card. We regret that we are unable to accept checks, money orders or cash for the payment of your monthly invoice.

If your check or automatic payment is declined for insufficient funds, or because your account is closed, or any other reason not under our control, you will be charged a declined payment fee of up to $30. We will ask you to bring your account current before you work out with us again.
